A vote to discriminate in car sales

       Car businesses in america, have been accused, and sued for raising interest rates on car sales towards African Americans, Asian Americans, and Hispanics. After multiple law suites against this issue, car business and banks were ordered to reimburse over 100 million dollars in total to those who were racially discriminated against. However Banks and car businesses found difficulty in this matter and later tried to implement a law, that would curb the anti-discrimination law, to allow them to discriminate in the car sales business. This law was put into action, but was greatly opposed by president Obama, and the congressional progressive urged lawmakers to vote against the law. The law was later passed with a 332 to 96 vote, with 88 democrats voting for the law and no republicans voting against it.

1) In what ways could this law be considered unconstitutional?
2) Why do you think so many democrats voted for this law?

  1. This law is unconstitutional because you can't discriminate over color. So many democrats probably voted for the law because they were convinced by lobbyist.

  2. This law could be considered unconstitutional because it would allow for discrimination in the car sales business. Democrats most likely voted for this law because they most likely recognized the right of a salesperson to sell cars however they had wished. The discrimination that they have pointed out does not necessarily mean racial. Salespeople might sell more to people who have a higher credit score, or who have proven they can meet the financial needs of the purchasing of the car.

  3. The law is unconstitutional because it discriminates colored people or any other race besides cacuasian. Democrats voted in favor because they felt that there rights were violated.

  5. This law could be seen as unconstitutional because in a way, it is legalizing racism, because dealers are purposely targeting and over charging certain races and not others. This law basically legalizes racism in car dealerships. However, like Will said, there are a lot of outside factors that could affect these rates that are not touched on in the article, so we don't know for sure that it is because of their race. With something like this, there are so many lurking variables that it is hard to separate a complete cause. I think most democrats voted for this law because they were probably bribed to vote for it, and make more money for themselves, so they probably voted for it because of that.

  6. This law could be considered unconstitutional because it is discrimination. The constitution states that all men are created equal, and to raise sales taxes on African Americans clearly breaks this. The democrats voted in favor of the law because they are liberals, while republicans are conservatives. They democrats clearly noticed that rights were being violated.

  9. Discrimination laws are unconstitutional. Many Democrats voted probably because they were bribed and/or convinced by lobbyists. This law needs to be changed because it's not fair for African Americans, Asian Americans, and Hispanics.

  10. Our constitution protects Americans against discrimination due to race, color, gender and religion. If car dealers are marking up the loan interests due only to a customer’s race, then it is unconstitutional. The fact that Obama “strongly opposed the bill” but did not threaten a veto, means there is likely more going on. Since a customer’s financial information and credit profile are submitted as part of their loan application, these factors might also play into the interest rate offered, as opposed to just a person’s race. The article did not fully explain all of the reasons for the decision made. The 88 Democrats who voted for the bill may have been influenced by their constituents, their lobbyists, or by logrolling with fellow lawmakers. It will be interesting to see what happens when the bill goes on to the Senate, and if it passes there, what happens when Obama is asked to sign it.

  11. In my opinion I don't see how this is right. It's unconstitutional to discriminate based on color, race, gender, religion etc. Maybe many Democrats voted for this law hoping that car dealerships will be able to prosper and succeed since they get to charge people more money.
