Summary: After a federal judge gave Kim Davis a mandate to license all couples that are eligible for marriage after she defied him, she has been working to stall it, asking the judge to postpone the mandate. She had been in jail for 5 days after refusing to give marriage licenses, despite the recent legalization of gay marriage. While in jail, her deputies began to issue licenses to the couples who had been denied licenses and sued Davis with the American Civil Liberties Union, omitting Davis' information on the documents. Despite numerous appeals over the mandate by Davis saying that she shouldn't have to issue more licenses since the couples who sued her had received licenses, they were all rejected, whether on technicalities or based on the fact that it what she was asking for would deny the right of all eligible couples to get married. The American Civil Liberties Union is also asking the district judge to make Davis reissue the licenses due to doubt over their validity.

ReplyDeleteI believe that the judge should force Davis to reissue the licenses that may be invalid. The Supreme Court ruling has power over individuals opinions, and whether or not a government worker believes that what the Supreme Court decided to do was right, he or she must honor the court's decision. According to the Supremacy Clause, the judge has the power to mandate Davis to license all couples.
ReplyDeleteMike Huckabee, a 2016 Republican presidential candidate and former Arkansas governor, was present when Kim Davis was released from jail after being imprisoned for refusing to issue marriage licenses to same-sex couples. Huckabee stated, "Lock me up if you think that's how freedom is best served, because…I'm willing to spend the next eight years in jail...But I'm not willing to spend one day under the tyranny of people who believe they can take our freedom and conscience away,” as noted by Catherine Cannon of CBS News. Huckabee’s spreading of religious ideals clearly proves he believes it is acceptable to overlook a Supreme Court decision.

Especially with the Supreme Court ruling in June which legalized gay marriage worldwide, Kim Davis should obey this decision. The judge does have the power to mandate Davis to license all couples. If Bunning agrees with the ACLU, Davis could be penalized if she still does not issue the licences.

Since the supreme court rulings have power over individuals and their ideas, Davis has to obey the court's final decisions. The judge does have the power to mandate Davis to license all couples because the supreme court ruled the legalization of gay marriage.
ReplyDeletethe judge does have the authority to force Davis for a reissue. Davis is obligated to follow the law and has no right to deny anyone of a marriage licenses, and could be prosecuted for doing so.

ReplyDeleteAny license that Davis' claimed unlawful should be reissued immediately. the judge is more than justified to mandate the license because its constitutional as of the time the law was passed by the supreme court
